Terms and Conditions

The following are the Terms and Conditions of Service for Zoe Edwards Tennis. All customers are required to accept these Terms and Conditions of Service prior to participation in all Zoe Edwards Tennis sessions

Zoe Edwards Tennis may, from time to time, review and update these Terms and Conditions, and reserves the right to amend or introduce any rules necessary to ensure the safe and efficient operation and financial viability of its facilities and programmes.

General

Sessions are available to individuals of 18 years of age and over, as well as children whose application form has been completed on their behalf by an adult.

After the 20-day trial period is over, you will not be in a contract but various sessions will be available for you to book onto. Payment for the first partial period will be calculated on a pro rata basis according to the days remaining in the termly period

Booking a package entitles the purchaser to a full or partial discount on sessions offered by Zoe Edwards Tennis. Some sessions and events may be excluded from this package.

This package is personal, and cannot be transferred or shared.

Sessions

Sessions are available according to times stated in the Zoe Edwards Tennis booking system.

Sessions and instructors are subject to change with no prior notice.

We reserve the right to refuse entry to a session or advise a more appropriate session/course if any participant is found not to be of the correct age/ability, or is unable to complete a session/course due to being in the incorrect age/ability group.

Booking into sessions

Players may book a place on Zoe Edwards Tennis sessions for themselves up to 7 days in advance.

Players will use Zoe Edwards Tennis's booking system in order to book their place on a particular session. No other methods will be considered as acceptable forms of booking.

If there are no bookings on a particular session 24 hours before the start time of that session, then Zoe Edwards Tennis reserves the right to cancel the session without having to communicate the cancellation to customers.

Waiting lists

Each session will have a maximum number of attendees allowed. This is to ensure the quality of the session and the safety of all participants.

Once the maximum number of attendees is reached, a waiting list will be created and customers will be contacted if places become available.

Player Detail Changes

You agree to advise us immediately of any change to the Player details held on our player database.

Termination

You may terminate your booking at any point by cancelling on Zoe Edwards Tennis’s booking system or by emailing info@zoeedwardstennis.com.

In the above circumstances your booking will remain in force until the day before your next payment is due, at which point it will automatically terminate.

Zoe Edwards Tennis reserves the right to suspend or terminate your booking if you behave in a way that breaches Zoe Edwards Tennis’s code of conduct

Payment

Your payment details will be securely stored in our system for the duration of the booking.

You are responsible for the payment of the booking. This is true even if the amount is debited directly by Zoe Edwards Tennis.

If, despite us having notified you of a missed payment, further payments are missed, we reserve the right to, at our sole discretion, terminate your membership, upon having given you written notice of our intention to do so.

Price changes

From time to time we may need to increase the price of a session or course. We will give you at least 1 full months' notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your session/course will cost after the increase.

During this period, you will have your usual right to terminate your booking in accordance with the terms and conditions and rules. If you do not terminate the bookings by the date given to you in the notice, then the price of your booking will be increased in accordance with our notice.

Refunds

Once paid, bookings will not be refunded for any reason. Booking periods may however be suspended (at the discretion of the management team) for the duration of a major medical absence / injury break, or other unforeseen circumstances, and resumed thereafter at no loss of time. Please note, this policy does not apply for minor injuries.

Disputes

Where possible all disputes will be prevented by open and honest communication between player, parent and coach. Where this is not possible, please put your dispute in writing to Zoe Edwards at info@zoeedwardstennis.com highlighting the issues you wish to raise. Zoe Edwards Tennis will then investigate the dispute and put in place processes to solve the dispute.

Pay-as-you-go bookings

Zoe Edwards Tennis players or members of the general public can, at any point, book onto one of our sessions via our pay-as-you-go scheme, provided there are spaces available in the session.

The booking must be made via Zoe Edwards Tennis’s online booking system and payment will be taken at the time of the booking.

Members will be given priority booking

Pay-as-you-go bookings cannot be transferred to anyone else.

Any pay-as-you-go booking cancellations must be made with more than 24 hours notice prior to the sessions start time, in order for the player to receive Zoe Edwards Tennis credit equal to 100% of the cost of the booking.

Zoe Edwards Tennis coaching staff will advise an attendee of a more appropriate session, or have the right to exclude a particular player from a session, if they do not have the right playing standard.

No-show policy

If a player fails to cancel their booking at least 24 hours prior to the start time of the session and then fails to attend the session, this will be considered a ‘no-show’.

A cancellation is only valid when a player cancels their booking to a particular session via Zoe Edwards Tennis’s online booking system, as this is the only way to open up that spot to other players who might want to book onto the session.

For players who are repeat offenders, we reserve the right to temporarily suspend online booking rights and/or to remove booking rights completely.

Zoe Edwards Tennis Booking Sessions

If a Zoe Edwards Tennis player has booked a single session or on a course and is a ‘no-show’ to a particular session then we reserve the right to issue a warning and a fine of £2 per session missed.

Pay-as-you-go bookings

If a player is a ‘no-show’ to a particular session after having booked on it on a pay-as-you-go basis, then we reserve the right to not issue a refund for the session.

Photos and videos

Attending a Zoe Edwards Tennis session, you agree to having your/your child photograph taken by Zoe Edwards Tennis at any time whilst taking part in the sessions. Zoe Edwards Tennis reserves the right to use any such photographs for press and/or promotional purposes.

If you find an image or video of your child on our promotional channels (such as our website and social media pages) that you’d like us to remove, please email us at info@zoeedwardstennis.com and we will do so immediately.

Health

You confirm that you/your child does not suffer from health problems that would hinder exercise or prevent you/your child from engaging in exercise, or that would be detrimental or adverse to you/your child’s health, safety or physical condition if you/your child did exercise. In case of any doubt, you shall seek advice by a medical doctor who should confirm the ability to exercise.

Zoe Edwards Tennis shall have no obligation to perform a fitness assessment or similar testing to determine your/your child’s physical condition.

Weather

It is our philosophy to try and run coaching sessions wherever possible and therefore we generally ask that participants attend the start of their session regardless of the weather.

Coaching will only be cancelled in advance if the appropriate forecasting tools (e.g. MET Office Rainfall Radar) indicate with certainty that the session would be unsafe to run. If it is not predictable with certainty, the decision on whether to cancel the lessons will be made on the courts immediately prior to the lesson start time.

Cancellation of one group lesson does not necessarily mean that other lessons will be cancelled that day. If you choose not to attend on doubtful days then you risk missing the class if it takes place

Liability

Zoe Edwards Tennis cannot accept liability for any claims, damages, costs and demands in respect of death or personal injury arising from the use of the facility and our sessions by the customer pursuant to this agreement except insofar as such death or personal injury arises from negligence on the part of the Zoe Edwards Tennis staff.

Zoe Edwards Tennis cannot accept responsibility for the loss of or damage to personal property incurred whilst on the premises.

Miscellaneous Terms

In the event that a single term, condition or rule of membership is found to be unenforceable, all other terms, conditions and rules shall remain unaffected.

If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.

You agree that your first and last name/your child’s first and last name will be shared with Zoe Edwards Tennis for the purpose of confirming to the club who has access to their premises.

Tennis Courts

No studded shoes to be worn on the tennis courts at any time.

There is no dress policy for the courts, however, players must not play shirtless at any time.

Chewing gum whilst on court is strictly forbidden.

Persons behaving in a manner likely to disrupt the enjoyment of, or endanger other users of the courts, may be asked to leave. No refunds will be given.

Should any damage occur during the period of court usage then the user will be responsible if caused by their negligence. Any damage must be reported immediately to the appropriate member of staff.

No Smoking Policy

In the interests of Public Health and comfort, smoking is not permitted on the courts, or clubhouse.


Holidays Terms and Conditions

For the purposes of the Data protection Act 1998, In order to process your booking and keep you informed of any relevant information relating to your booking, and to ensure that your travel arrangements run smoothly and meet your requirements we need to collect certain personal details from you.

These can include the names and addresses of any party members and may need us to know any special needs & medical / dietary requirements. We must pass the information on to the relevant suppliers of your travel arrangements such as hotels, transport companies which may be outside the European Union.

We will not however, pass any information onto any persons that are not responsible for any part of your travel arrangements. This applies to any sensitive information that you give us such as details of any special needs or medical/dietary requirements.

We take responsibility for ensuring that proper security measures are in place to protect your information. We may use the information provided by you to contact you about your holiday or to inform you about details of other holidays and services offered by us.

Bookings & Payments

By paying your deposit or full payment you are accepting Zoe Edwards Tennis terms and conditions for your holiday.  A minimum deposit of 50% per person is required at the time of booking. The full balance is due 14 weeks before departure. These booking conditions form the basis of your contract. The right is reserved to cancel any booking not paid by the due date. The lead traveller must be at least 18 years old. All client funds are paid to Zoe Edwards Tennis.

On receipt of your deposit we will make the necessary reservations and your deposit is accepted in part payment of the agreed total cost of the booking. At the point we receive your deposit payment we secure your accommodation immediately & therefore the deposit becomes non – refundable.

Late Bookings

For all bookings made within 14 weeks of departure, the full amount of the holiday cost are required to be paid.

Passports, Visas & Travel Documents

Please check your confirmation email / itinerary paperwork carefully and report any incorrect or incomplete information to us immediately. You must ensure that names are exactly as stated in the relevant passport. Please ensure that your passport / visa is valid for the duration of your holiday. We strongly recommend that each individual passport expiry date is 6 months after the return date of your holiday.   

Insurance

It is essential that all clients  arrange their own suitable & adequate travel / holiday insurance cover. Your travel insurance should then provide cover in the event of cancellations or curtailment due to injuries that can occur in sport.

Cancellation

Occasionally changes to your holiday are necessary due to circumstances beyond our control, we would advise you prior to departure, or even during your holiday if changes occur.

Changes

We plan the arrangements for our holidays many months in advance and although it is unlikely that we will have to make any changes to confirmed arrangements, it does occasionally happen.

We reserve the right to make such changes at any time. If we have to make a major change to your holiday you may either: (a) Accept the changed arrangements. (b) Purchase another holiday from us at the same price within 12 months of the original travel departure date.

If it becomes necessary for you or any member of your party to cancel your booking or part of it, you must inform us in writing immediately via email to info@zoeedwardstennis.com Cancellation charges are calculated from the date we receive written notification. Please see below: More than 98 days before departure - Loss of Deposit. From 97 to 1 day before departure - 100% of total holiday to the original booking itinerary, you do so at your own expense. 

Sports Programmes

We do not accept any responsibility in the event of inclement weather to the sports programmes, which may need to be rearranged. Every effort will be made to make up the lost hours but this cannot be guaranteed. Our clients freely accept the risk that weather conditions may affect in whole or part the number of hours to be provided. Tennis and other sports at all our resorts reserve the right to cancel or revise published programmes and events at their discretion

Force Majeure

We cannot accept liability in any circumstances where performance and/or prompt performance of the contract is prevented by reasons of war, threat of war, civil strife, riots, terrorist activities, industrial disputes, communicable diseases, natural and nuclear disaster, fire or adverse weather conditions.

Website & Social Media Publicity

By confirming your booking with Zoe Edwards Tennis you consent to be photographed and to be included in the filming of any footage documenting Zoe Edwards Tennis  or events. You hereby grant Zoe Edwards Tennis the irrevocable and unrestricted right to use and publish photographs of you or any members of your party, for Website & social media, advertising, internet and any other marketing purpose on any medium; to alter the same without restriction; and to copyright the same, save always that Zoe Edwards Tennis hereby undertake never to utilise any such photographs in a defamatory manner and shall keep such photographs secure throughout the period of their use. You hereby release Zoe Edwards Tennis and the photographer from all claims and liability relating to the said photograph or footage.

Accommodation

On the day of arrival your standard check in times for our hotel is between 1pm and 4pm . However, for earlier arrivals we will do our best to gain earlier access or you can book the hotel room / apartment / villa from the previous night at the appropriate supplement. On the departure day the standard check out time is 10am regardless of your original time of arrival. For late flight departures we will do our best to extend the check out time. It is common practice for our accommodation to take a credit card details on arrival/check-in as a guarantee for owners of incidental expenses and any accidental damages that have occurred during your stay to the property and lose of its contents. Our accommodation suppliers will notify and report any loss or damage caused (normally on a daily basis) during your stay to us within 1 - 7 days after your departure date which you could be liable for. Photo evidence may be taken of certain damage and the damaged item/s removed from the accommodation for Health & Safety reasons. You must therefore report any faults/damage that you see on your arrival. From time to time our accommodation suppliers cancel prior to clients departure dates or you have to be move clients through no fault of yours or us, this could be half way through your holiday due to for example ‘no hot water’! or other unforeseen reasons that are out of our control. In both circumstances alternative accommodation will be offered of an equivalent or higher standard, we cannot be held responsible if this occurs.

Tennis Equipment & Attire

Please make sure all tennis players have the correct shoes that are fit for purpose. It is dangerous and not permitted to play in anything but recognised tennis shoes. Players will be asked to leave the court due to health & safety reasons if deemed to be wearing the wrong footwear. Recognised tennis apparel is also recommended. IF YOU ARE IN ANY DOUBT PLEASE DO NOT HESITATE TO CHECK BEFORE YOU TRAVEL WITH ZOE EDWARDS TENNIS BOOKING OFFICE OR OPERATIONS MANAGER.

Matches/Fixtures

We go to great lengths to ensure the reliability and success of every match/fixture/competition we arrange. While we take every possible step to prevent tour matches / fixtures / tournaments suffering last minute cancellations, in very small minority of cases, this can happen. It is not always possible to guarantee the perfect level of all opponents.

Personal Possessions

Zoe Edwards Tennis cannot be responsible for damaged caused to any tennis equipment or possessions including tennis rackets that may get damaged or broken during your tour/holiday. We do not take any responsibility for any loss or damage to personal belongings during your trip. Please use the safe provided in your accommodation if available or carry your valuable personal
